Agreement to These Terms

These Terms of Service ("Terms") govern access to and use of qmpwebdesign.pages.dev and the services of Q.M.P Web Design & Tech (collectively, the "Services"). By booking a service, purchasing, or otherwise using the Services, you agree to these Terms and all incorporated policies, including our Refund Policy. If you do not agree, do not use the Services.

Eligibility

You must be legally capable of entering a binding agreement. Customers under the age required by applicable law may use the Services only with valid parent or guardian consent where permitted. You are responsible for accurate contact and payment information, and for all activity occurring through your bookings and communications with us.

Our Services

Q.M.P Web Design & Tech provides web design, phone repair (including unlocking, bug fixes, and system updates), security & cleanup, data rescue, YouTube content services, and related services. Features may be added, changed, suspended, or discontinued. Availability may vary by service or legal requirements. We always confirm scope and price with you before work begins.

Deposits and Paid Services

Services start at $19.99. A 30% deposit is required once price & payment are discussed — deposits are non-refundable once a service is chosen and booked. New customers get $10 off their first order, and successful referrals earn a $10 reward. Cancellation does not automatically create a refund except where required by law or expressly stated in the Refund Policy.

Purchases

All purchases are subject to displayed prices, taxes, fees, availability, payment authorization, fraud screening, and any service-specific terms. We may cancel or limit orders for suspected fraud, pricing errors, legal restrictions, or abuse.

Your Content

You retain ownership of content you lawfully own and provide to us (text, photos, logos, videos). By giving us content for your website or service, you grant Q.M.P Web Design & Tech a non-exclusive, worldwide, royalty-free license to host, reproduce, format, display, and technically adapt that content as reasonably necessary to deliver your service. You represent that you have all rights necessary to provide the content and that it does not infringe another person's rights.

Acceptable Conduct

You may not use the Services for unlawful activity; fraud; impersonation; harassment; threats; malware; scraping or automated access contrary to our instructions; infringement; spam; payment abuse; or interference with our website's security or operation.

Intellectual Property

Q.M.P Web Design & Tech names, logos, graphics, page designs, and original content are owned by Q.M.P Web Design & Tech. Upon full payment, you own the website and content we create for you. No other license is granted except the limited right to use the Services under these Terms.

Third-Party Services

Our Services may rely on payment processors (Zelle, Cash App), hosting providers, email services, or other third parties. Their terms may also apply. Q.M.P Web Design & Tech is not responsible for third-party services outside its control.

Suspension and Termination

We may restrict, suspend, or terminate service for material or repeated violations, fraud, security threats, legal requirements, nonpayment, or conduct that creates material risk. You may stop using the Services at any time.

Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." Q.M.P WEB DESIGN & TECH DOES NOT GUARANTEE UNINTERRUPTED AVAILABILITY OR PARTICULAR COMMERCIAL RESULTS. NOTHING IN THESE TERMS EXCLUDES WARRANTIES OR RIGHTS THAT CANNOT LAWFULLY BE EXCLUDED.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Q.M.P WEB DESIGN & TECH AND ITS OWNER WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOST PROFITS OR DATA ARISING FROM THE SERVICES. ANY AGGREGATE LIABILITY WILL BE LIMITED TO THE GREATER OF AMOUNTS YOU PAID TO Q.M.P WEB DESIGN & TECH FOR THE APPLICABLE SERVICE DURING THE TWELVE MONTHS BEFORE THE CLAIM OR $100, EXCEPT WHERE SUCH LIMITATION IS PROHIBITED BY LAW.

Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Q.M.P Web Design & Tech from claims arising from your unlawful conduct, your content, your infringement of third-party rights, or your material breach of these Terms.

Disputes; Governing Law

These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles, except where mandatory consumer law provides otherwise. The parties consent to state and federal courts located in Georgia for disputes.

Changes

We may update these Terms prospectively. For material changes, we will provide notice as required. Continued use after the effective date of changes constitutes acceptance where permitted by law.
